국민과 혼인하여 결혼생활을 영위하다 국민과의 사이에 출생한 자녀가 있는 외국인배우자가 국민과 이혼을 하고 한국인 자녀를 양육을 하고 있는 경우가 있습니다.

이 경우, 이전에는 한국인 자녀를 양육하고 있는 외국인배우자가 한국인 자녀가 성년이 되면서 F6-2비자가 소멸하여 더 이상 자녀와 한국에서 생활할 수 없는 경우가 많았습니다.

최근 법무부는 2021년 1월 28일부터 '자녀가 성년이 된 자녀 양육자 (F6-2비자 소지 외국인배우자)에 대한 거주자격 비자 (F2-15비자)를 신설하였습니다.

기본 조건들을 살펴보면 하기 조건을 충족해야 합니다.

1. 국내 계속 체류 할 것;

2. 국내 생활기반이 있을 것;

3. 자녀와 동거하며 양육하고 있을 것;

또한, 해당 지침이 시행되는 2021년 1월 28일 이전에 자녀가 성년이 된 경우에 대한 특례 규정되 신설되었습니다.

자녀가 성년이 된 자녀양육자 (F6-2비자)에 대한 거주 (F2-15비자) 자격 변경

가. 대상

국민과의 혼인관계 단절 후 한국인 배우자와 사이에 출생한 자녀를 성년이 될 때까지 국내에서 양육한 외국인 부 또는 모

나. 자격요건

1. 신청자의 체류자격:

신청일 현재 자녀양육 (F6-2비자) 자격으로 적법하게 체류할 것

2. 국내 계속 체류기간:

국민의 배우자 (F6-1비자), 자녀 양육 (F6-2비자), 혼인단절 (F6-3비자) 자격으로 5년 이상 계속하여 국내에 체류할 것

3. 국내 생활기반 일것:

신청인 (자녀 양육자)과 자녀의 생활기반이 국내에 형성되어 있을 것

-신청인 (자녀 양육자)과 자녀 모두 신청일 기준 5년 이내 해외에서 체류한 기간이 국내에서 체류한 기간을 초과하지 않을 것

4. 자녀 양육: 자녀와 동거하면서 실제 자녀를 양육하고 있을 것.

5. 자격변경 신청 시기:

자녀가 민법상 성년이 되기 4개월 전부터 자녀양육 (F6-2비자) 자격으로 체류기간 만료일까지 신청할 수 있다.

6. 국내 정주에 필요한 기본 요건:

품행단정, 생계유지 능력 (중위소득의 40%), 기본 소양 (사회통합프로그램 4단계 이상 교육 이수)

**다만, 신청인과 자녀 중 "중증질환" 또는 "중증장애"가 있는 경우, 생계유지능력의 요건은 면제한다.

**특례 대상**

최초 시행일 (2021년 1월 28일) 이전에 자녀가 성년이 됨에 따라 해당 지침을 적용하여 체류자격 변경허가를 신청할 수 없었던 사람 중 다음 하나에 해당하는 사람은 신청할 수 있다.

1. 방문동거 (F-1비자)등 다른 체류자격으로 체류중인 사람;

2. 기본 체류자격의 연장 또는 다른 체류자격으로 변경을 신청하였으나, 자녀가 성년이 되었다는 이유만으로 불허처분을 받은 사람;

3. 기존 체류자격의 연장 또는 다른 체류자격으로 변경을 신청하지 않은 사람은 2022년 1월 27일까지 체류허변경 허가 신청을 허용한다.

NOTICE of Adjustment (Extension) of the Period of Stay for Non-Professional Employment (E-9 VISA Holders) Foreign Workers by Official Authority

In order to solve the difficulties of supplying and receiving foreign workers due to Corona 19, The Ministry of Justice has decided to extend the period of stay for non-professional employment (E-9 VISA) foreigner workers as follows:

(1) As foreign workers holding E-9 visa, who are eligible for non-professional employment (E-9 VISA) and whose employment period expires between Feb. 1, 2021 to Feb. 28, 2021 (3 years or 4 years 10 months) and

(2) Legal residents staying in Korea at the time of the effective date (Jan. 26, 2021).

- Those who have completely left Korea;

- Those who have already received an extension of his/her stay of 50 days as persons who are expected to re-enter Korea again;

- Those who have already left Korea at the time of the effective date (Jan. 26, 2021);

- Those who have already permitted to extend his/her stay through visit reservation or online;

- Death, missing persons, delinquents (unpaid) health insurance and tax;

- Those who have received an extension of period for departure (Article 32 of the Enforcement Rules of the Immigration Act) or a grace period for departure (Article 33 of the Enforcement Rules of the Immigration Act) before taking measures by authority;

- Those who have already passed the application period for change of work place, or those who have already passed the period of change of work place; or

- Those who have received permission for re-employment through the competent Employment and Labor Administration before the effective date (Jan. 26, 2021).

**General eligible persons other than those excluded by Authority will be extended up to 50 days from the expiration date of stay.

**Even if you visit the competent Immigration Office, the extended period by authority will not be separately indicated on the alien registration card.

**You MUST check through Hi Korea website from Jan. 27, 2021.

비전문취업(E-9) 체류기간 직권 조정(연장) 안내문

코로나19로 인한 외국인근로자 인력 수급의 어려움을 해소하고자 비전문취업(E-9) 외국인의 체류기간을 다음과 같이 직권 연장하기로 하였습니다.

1. 대상자 (2 조건을 다 갖추어야 함):

(1) 21. 2. 1. ~‘21. 2. 28. 사이에 취업활동기간(3년 또는 4년10개월)이 만료되는 비전문취업(E-9)자격을 가진 외국인으로서,

(2) 시행일(’21. 1. 26.) 당시 국내 체류 중인 합법체류자

<직권 연장 처리 제외 대상 >

-완전 출국한 사람;

-재입국특례 입국 예정자로 이미 50일 체류기간 연장을 받은 사람

-시행일(‘21.1.26.) 당시 해외출국자;

-이미 방문 또는 온라인을 통해 체류기간연장허가 등 민원접수를 한 사람;

-사망자, 소재불명자, 건강보험 ‧ 조세 체납자;

-직권 연장 조치 이전에 출국을 위한 기간연장(출입국관리법시행규칙 제32조)이나 출국기한의 유예(출입국관리법시행규칙 제33조)를 받은 사람;

-사업장변경 신청 도과자, 사업장변경 기간 도과자;

-시행일(‘21. 1. 26.) 이전 관할 고용노동청을 통해 재고용허가를 받은 사람.

**위 직권 연장 처리 제외대상 이외의 일반 대상자는 체류만료일로부터 50일까지 직권 연장 처리됩니다.

**관할 출입국‧외국인청 등을 방문하더라도 직권 연장된 기간을 별도로 외국인등록증에 표기해 드리지 않습니다.

2021 E7-4 VISA Application 2021년 점수제 숙련 기능인력 선발 계획

1. Regular Application (일반 신청):

- Totally 4 times per each Quarter: 170 Persons

-1st Quarter: Mar. 22, 2021-Mar. 25, 2021, Result (Apr. 12)

-2nd Quarter: Jun. 28, 2021-Jul. 1, 2021, Result (Jul. 19)

-3rd Quarter: Sep. 27, 2021-Sep. 30, 2021, Result (Oct. 18)

-4th Quarter: Dec. 9, 2021-Dec. 14, 2021, Result (Dec. 24)

2. Higher Points Applicants (고득점자 신청):

-150 Persons, anytime before quota is finished with 65 points or higher

-2018 & 2019 Income Certificate (Jan. 1~Mar. 19, 2021)

-2019 & 2020 Income Certificate (Mar. 20~ until this quota is finished)

3. Recommendation (추천서):

-Manufacturing (Ministry of Labor & Employment): 200 Persons;

-Root Industry (Ministry of Trade, Industry and Energy): 70 Persons;

-Agriculture & Live Stock (Ministry of Agriculture, Food and Rural Affairs): 50 Persons;

-Totally 72 points including 35 points or higher on Future Contribution Value (age, Korean language, Academic degree)

5. Yearly Income Acceptance (연간 소득 인정 범위):

-1st Quarter: 2019 Income Certificate issued by Tax Office and 2020 Earned Income Payment Statement issued by Home Tax

-2nd Quarter to 4th Quarter: 2019 & 2020 Income Certificate issued by Tax Office

**If your visa was expired but if your work as a seasonal worker after Aug. 21, 2020 by recommendation from the Ministry of Labor & Employment, your may get additional points such as working 1 month (1 point), working 2 months (2 points), working 3 months (3 points: 비전문취업(E-9)으로 체류했던 자로서 체류기간 만료 후 2020.8.21.이후 시행된 계절근로 사업에 고용노동부 추천을 받아 참여한 경우, 기간에 따라 가점 부여)

한국어 출입국 강의 한국어 KIIP 사회통합프로그램 이수가 필요 없는 영주자격_VISA in KOREA 장행닷컴행정사2018년도 5월에 출입국관리법이 개정되기 전에 국내에 체류하고 있는 외국인이 영주권 (영주자격: F-5비자)을 취득하기는 조금 수월했습니다.

예를들면, E-7비자 특정활동비자로 5년 이상 한국에서 거주하는 경우, 영주권 (영주자격: F-5비자)을 신청할 수 있었으며, 10년 이상 한국에서 거주하는 경우에는 한국어 요건이 면제되기도 했습니다.

2018년 5월에 출입국관리법이 개정되고 나서, 특별한 경우를 제외하고는

영주권 (영주자격: F-5비자)을 신청하기 위한 전제요건이 바로 사회통합프로그램인 KIIP를 이수하는 것이 되었습니다.

사회통합프로그램 KIIP는 0단계부터 5단계로 나뉘고, 1단계부터 4단계까지는 100시간, 5단계 영주자격용은 50시간, 5단계 귀화용은 20시간을 이수하고, 시험을 통해 합격을 해야 됩니다.

시간도 시간이지만 중간평가와 종합평가 항목은 정말 쉽지 않은 부분들이 있습니다.출입국관리법 개정으로 거의 의무화가 된 사회통합프로그램 KIIP도 예외가 적용되고 있지만,

영주권 (영주자격: F-5비자) 신청 시, 사회통합프로그램을 이수하지 않아도 되는 영주자격이 있습니다.

Starting March 1, 2021, foreign students who enter the country planning to stay more than six months and holding a D-2 visa or a general trainee D-4 type visa should sign up for the state health insurance.
