안녕하세요, VISA in KOREA & 장행닷컴 JOBS의 장만익 행정사입니다. 이번 2026년 6월 1일부터 외국인 근로자(E-9)분들께 매우 유리하게 개정된 E-7-4 비자 지침을 핵심만 압축하여 알려드립니다. (Hello, I am Jang Man-ik from VISA in KOREA. Here is a short summary of the new E-7-4 visa rules starting June 1, 2026.)


첫째, 회사의 폐업, 임금체불, 부당대우 등 근로자의 잘못이 없는 사유로 이직한 경우, 기존의 '새 회사 1년 이상 근무' 조건이 면제됩니다. 이제는 고용노동부 신고 증빙만 있다면 이전 회사 근무 기간과 새 회사 기간(최소 3개월)을 합산할 수 있으며, 이 합산 기간이 1년 이상이면 즉시 신청이 가능하고 3년 이상이면 근속 점수 20점을 추가로 받게 됩니다. (First, if you changed companies due to company problems like closure or unpaid wages, you don't need to wait 1 year at your new company. If your total time from the old and new company is over 1 year, you can apply right away. If it is over 3 years, you get 20 extra points.)


둘째, 농축어업 분야의 비자 발급 비율(쿼터)이 인구감소지역 수준인 한국인 직원의 최대 50%까지 대폭 확대되어, 기존 30% 제한으로 비자 변경이 어려웠던 분들의 숨통이 트이게 되었습니다. 다만 제조업은 이번 혜택에서 제외되므로 유의하시기 바랍니다. (Second, the E-7-4 quota for agriculture, livestock, and fisheries has expanded up to 50% of the Korean staff number. Note that there is no big change for manufacturing.)

Moving from an E-9 to an E-7-4 visa can be confusing, especially when it comes to your legal record. Many workers worry about a "1 million won fine," but it is very important to know exactly what kind of fine it is.


In Korea, there is a big difference between a Criminal Fine (Beol-geum) and an Immigration Penalty (Beom-chik-geum). A criminal fine is a serious punishment for crimes like fighting (violence), driving without a license, or drunk driving (DUI). If you receive a criminal fine of 1 million won or more, you are usually disqualified from applying for the E-7-4 visa.


On the other hand, many E-9 workers face problems while they are looking for a new job. If you work illegally before you officially join a new company and get caught, the Immigration Office will charge you a penalty. Even if this penalty is 1 million won (or up to 2 million won for one month of illegal work), it is not a criminal fine. This is simply a violation of the Immigration Act.


The good news is that if you paid a 1 million won penalty for working during your job-seeking period, you can still apply for the E-7-4 visa. It does not block your application like a criminal record does. However, please remember that you will lose 5 points from your total score as a penalty.


To summarize, if your 1 million won was for violence or driving mistakes, it is a criminal fine and you cannot apply. But if it was for working while changing jobs, it is an immigration penalty, and you can still apply as long as you can handle the -5 point deduction.

From May 1, the income certificate for 2025 becomes available. This means you can now apply for the E-7-4 visa using both your 2024 and 2025 income records. This is important because your 2025 income is now a key requirement for application.


Just today, a client visited our office from Ansan. He was unsure about their eligibility and confused about the income requirements. After reviewing his case carefully, we identified a viable pathway and started the application process immediately. Situations like this are very common—many people assume they are not eligible when in fact they have a strong chance.


Right now, there is also a temporary advantage. The Korean language requirement is waived until December 31, 2026. This gives many applicants a valuable opportunity to apply sooner than expected. In many cases, applicants can qualify with a score of 150 points or by having worked for more than three years on an E-9 visa, especially outside Seoul, Incheon, and Gyeonggi. Even if your score is slightly less points, a recommendation from a local government can add up to 30 extra points, which can make a critical difference.


However, there is one point that many people overlook. Without TOPIK Level 2, you cannot bring your spouse under the F-3-74 visa. So while the language requirement is currently waived for the main application, Korean proficiency is still important for long-term planning.


The biggest issue I see is not lack of qualification, but misunderstanding. People apply under the wrong conditions, choose the wrong timing, or submit incomplete documents. That’s when rejections happen—and once rejected, it becomes more complicated the next time.


What makes the difference is not just meeting the requirements, but having the right strategy from the beginning.

Is Level 2 Korean language proficiency mandatory for family invitation (F-3) for E-7-4 visa workers, and for E-7-4R visa workers changing from a C-3 visa to an F-3-3R visa for his/her Spouse in Korea?


After seeing a recent post on the community, I will reorganize and repost the content I previously lectured on and posted.


When changing to an E-7-4 visa, you can apply without Level 2 Korean language proficiency until December 31, 2026.


However, to invite a spouse via an F-3 visa, the worker holding the E-7-4 visa must obtain Level 2 Korean language proficiency.


The guidelines state, "If an E-7-4 visa holder fails to meet the Korean language proficiency requirements within two years, family invitation is not possible."


The phrase "within two years" appears here because the E-7-4 visa is granted for two years from the start, but it is said to be because the E-7-4 visa is originally granted for two years at a time.


Workers holding an E-7-4R visa can also invite their spouse for a C-3 visa.


However, it is said that even workers holding an E-7-4R visa must obtain Level 2 Korean proficiency to change their spouse's C-3 visa to an F-3-3R visa.


(*This situation does not occur when applying for an F-3-1R visa as the spouse of an F-2-R visa holder, because the F-2-R visa holder has already completed Level 4 of the KIIP.)

1. To apply for an E-7-4 visa, should I verify the period of stay in Korea under an E-9 visa, or the period of employment under an E-9 visa?


- The target group consists of current registered foreign nationals who have resided in Korea for at least 4 years within the last 10 years under E-9, E-10, or H-2 status and are currently engaged in regular employment at their workplace.


- In other words, the 4-year calculation is based on the period of stay, not the actual period of employment under the E-9 visa.

"Is Korean required when extending an E-7-4 visa? I received my visa in February 2024..."


1345 helpline gives different answers depending on who you talk to.


A foreign worker called me today. 


He received his E-7-4 visa in February 2024 and has worked at the same company for over eight years. 


When he called 1345, he was told that he needs a Korean Level 2 certificate to extend his visa, and that without it, he would only receive a six-month extension with no further extensions allowed after that. 


However, when I called a different 1345 center myself, I got a completely different answer - that some immigration offices require Level 2 Korean while others do not, depending on which office handles the case. 


This made it impossible to know which answer was actually correct.


So here is the actual rule, explained simply. 


The key question is when you received your E-7-4 visa.


If your visa was approved before November 27, 2024, you do not need Level 2 Korean to extend it, and you can extend your visa until December 31, 2026. 


However, if your visa was approved on or after November 27, 2024 - for example, if you applied on November 27, 2024, and were approved in January 2025 - then you will need Level 2 Korean when you extend your visa.


This means the worker who called me today, since he received his E-7-4 visa in February 2024, does not need Level 2 Korean right now. 


He can extend his visa without it, as long as he does so before December 31, 2026.
