Is Level 2 Korean language proficiency mandatory for family invitation (F-3) for E-7-4 visa workers, and for E-7-4R visa workers changing from a C-3 visa to an F-3-3R visa for his/her Spouse in Korea?
After seeing a recent post on the community, I will reorganize and repost the content I previously lectured on and posted.
When changing to an E-7-4 visa, you can apply without Level 2 Korean language proficiency until December 31, 2026.
However, to invite a spouse via an F-3 visa, the worker holding the E-7-4 visa must obtain Level 2 Korean language proficiency.
The guidelines state, "If an E-7-4 visa holder fails to meet the Korean language proficiency requirements within two years, family invitation is not possible."
The phrase "within two years" appears here because the E-7-4 visa is granted for two years from the start, but it is said to be because the E-7-4 visa is originally granted for two years at a time.
Workers holding an E-7-4R visa can also invite their spouse for a C-3 visa.
However, it is said that even workers holding an E-7-4R visa must obtain Level 2 Korean proficiency to change their spouse's C-3 visa to an F-3-3R visa.
(*This situation does not occur when applying for an F-3-1R visa as the spouse of an F-2-R visa holder, because the F-2-R visa holder has already completed Level 4 of the KIIP.)

"Is Korean required when extending an E-7-4 visa? I received my visa in February 2024..."
1345 helpline gives different answers depending on who you talk to.
A foreign worker called me today.
He received his E-7-4 visa in February 2024 and has worked at the same company for over eight years.
When he called 1345, he was told that he needs a Korean Level 2 certificate to extend his visa, and that without it, he would only receive a six-month extension with no further extensions allowed after that.
However, when I called a different 1345 center myself, I got a completely different answer - that some immigration offices require Level 2 Korean while others do not, depending on which office handles the case.
This made it impossible to know which answer was actually correct.
So here is the actual rule, explained simply.
The key question is when you received your E-7-4 visa.
If your visa was approved before November 27, 2024, you do not need Level 2 Korean to extend it, and you can extend your visa until December 31, 2026.
However, if your visa was approved on or after November 27, 2024 - for example, if you applied on November 27, 2024, and were approved in January 2025 - then you will need Level 2 Korean when you extend your visa.
This means the worker who called me today, since he received his E-7-4 visa in February 2024, does not need Level 2 Korean right now.
He can extend his visa without it, as long as he does so before December 31, 2026.

Getting an E-7-1 visa in Korea is not just about your skills; your company must also meet specific rules.
One of the most important rules is the 20% domestic ratio.
Basically, the Korean government wants to make sure companies hire enough local citizens before they hire foreign professionals.
For every foreign employee a company wants to sponsor, they usually need to have at least five Korean employees. This means the number of foreign staff cannot exceed 20% of the total full-time Korean workforce.
If a small company has only two or three Korean workers, they might not be allowed to hire you on an E-7 visa at all.
Also, the company must be healthy and pay its taxes on time to prove they can support you.
If the company is too small or has financial problems, the immigration office may reject the application.
Understanding these hurdles is very important before you start your job search.

Due to the current economic downturn in South Korea, there have been many inquiries regarding workplace changes for foreign workers holding E-7-4 visa. 요즘 대한민국 경기가 좋지 않아서 E-7-4 비자 가지고 계신 외국인 근로자의 근무처 변경에 대한 문의가 많이 있습니다.
There are two main situations in which a foreign worker with an E-7-4 visa may change their workplace. E-7-4 비자를 가지고 있는 외국인 근로자가 근무처 변경을 하는 경우는 크게 2가지가 있습니다.
1. When the employment contract for the foreign worker holding the E-7-4 visa is still valid. E-7-4 비자를 가지고 있는 외국인 근로자의 근로계약서 기간이 남아 있는 경우
- If the employment contract for a foreign worker with an E-7-4 visa is still valid, you may apply for a workplace change by preparing the relevant documents in the following cases: 1) the company has closed or suspended operations; 2) the company's revenue has decreased significantly; 3) wages have not been paid for more than three months; or 4) unreasonable incidents such as verbal abuse or physical assault have occurred. 만약 E-7-4 비자 외국인 근로자의 근로계약서 기간이 남아 있는 상황에서 근무처를 변경하기 위해서는 1) 회사 폐업이나 휴업, 2) 회사의 매출액이 많이 감소한 경우, 3) 월급이 3개월 이상 지급되지 않았거나 4) 폭언, 폭행 등 불합리한 일이 발생했을 때 관련 서류를 준비해서 근무처 변경을 신청할 수 있습니다.
2. Cases where the employment contract period of a foreign worker holding an E-7-4 visa is nearing its end. E-7-4 비자를 가지고 있는 외국인 근로자의 근로계약 기간이 거의 끝나가는 경우
1) Cases where there is a reason to change the workplace, such as the company closing down or suspending operations 회사가 폐업, 휴업 등 근무처 변경 이유가 있는 경우
- In this case, the foreign worker with an E-7-4 visa may change their workplace or switch to a D-10 visa, which allows for job seeking. 이 경우에는 E-7-4 비자 외국인 근로자가 근무처 변경 또는 구직할 수 있는 D-10 비자로 변경할 수 있습니다.
- Generally, the immigration office grants a 14-day period. If the worker finds a new workplace within that time and can change their workplace under the E-7-4 visa, the change is processed as a 'change of workplace'; otherwise, the change is processed as a D-10 visa for job seeking. 일반적으로 출입국사무소에서는 14일의 시간을 주고 근무처를 그 기간에 찾아서 E-7-4 비자로 근무처 변경을 할 수 있으면 '근무처 변경'으로, 그렇지 않으면 구직비자인 D-10 비자로 변경할 수 있도록 하고 있습니다.
2) Cases where the employment contract period is nearing its end 근로계약 기간이 끝나가는 경우
- Unless the company has closed down or suspended operations and there are special circumstances allowing for a change of workplace, a foreign worker with an E-7-4 visa who has already secured a company may apply for a change of workplace typically 2 to 3 days before their visa expires. However, please note that there may be slight variations depending on the immigration office. 회사가 폐업, 휴업 등의 상황이 발생하지 않고 근무처를 변경할 수 있는 특별한 사정이 없는 한, 회사를 미리 구한 E-7-4 비자 외국인 근로자는 근무처 변경 신청을 통상 비자 만료 2일~3일 전에 신청할 수 있습니다. 다만, 이 경우도 출입국사무소마다 약간의 차이가 있을 수 있으니 참고 바랍니다.
- Foreign workers on E-7-4 visas who have not found a company will change to a D-10 job-seeking visa. Although there are slight differences depending on the immigration office, it is said that you can change to a D-10 visa starting from one day before your current visa expires. 회사를 구하지 못한 E-7-4 비자 외국인 근로자는 구직비자인 D-10 비자로 변경하게 됩니다. 출입국사무소마다 약간의 차이는 있지만 비자만료일~1일 전부터 D-10 비자로 변경할 수 있다고 합니다.

Previously, I mentioned that for an E-7-4 visa worker to change workplaces, the new company must have either an E-9 visa or an H-2 visa holder.
However, what happens if the new company does not have any E-9 visa holders, but only workers who have switched from an E-9 visa to an E-7-4 visa?
While the 1345 only discussed the general principles, it is said that detailed guidelines have recently changed.
In other words, even if the new company does not have any E-9 visa holders, if a worker who previously held an E-9 visa is currently working at the company under an E-7-4 visa, it is considered as if an E-9 visa holder is employed at the new company.
Therefore, if there is one E-7-4 visa holder at that company, it is considered as if there is an E-9 visa holder, and the E-7-4 visa quota is determined based on the number of Korean nationals. Now, even if an E-7-4 visa worker changes workplaces, they can change workplaces even if there are no E-9 visa workers at the new company, provided that there are E-7-4 visa workers at the new company and there is an E-7-4 visa quota remaining.
