When applying for a specific activity visa (E-7-1), at which immigration office do you apply for a visa change?

When applying for a specific activity visa (E-7-1) after graduating from college, should you go to the immigration office that has jurisdiction over your residence or the immigration office that has jurisdiction over your hiring company's address?

Graduation season for international students in Korea is back. I think the international students who are graduating this time have suffered a lot of things to study during COVID-19 era. So, they have high expectations for the first face-to-face graduation ceremony.

However, along with that, I think you will have a lot of concerns because of the procedures to find a job in Korea and change for a specific activity visa (E-7) after finding a hiring company.

First of all, as I have posted before, rather than changing to a specific activity visa (E-7) immediately after graduation from D-2 visa, I have recommended changing to a job-seeking visa (D-10) and then taking time to look for a better job.

However, fortunately, there are some international students who have succeeded in finding a job immediately after graduating from college.

Anyway, if the international student is living in Seocho-gu (under the jurisdiction of the Seoul Immigration Office) and the company he/she is working for is in Jongno-gu (under the jurisdiction of the Sejong-no branch of the Seoul Immigration Office), where he/she shall apply for his/her E-7 visa? 

In this case, should you make a reservation for a visit to the immigration office based on where you live, or should you make a reservation for a visa change application at the immigration office where you have a company to work for?

My correct answer is that:

You can apply at either the immigration office that has jurisdiction over the place where you live or the immigration office that has jurisdiction over the company address where you will work.

However, when applying for a specific activity visa (E-7), it is recommended that you apply at the immigration office in the jurisdiction where the company you are working for is located.

Because, sometimes, an actual investigation and examination of the company from the immigration office where you will be working for are need to be required. So, kindly consider this case and reserve a reservation for a proper immigration office for your E-7 visa change application.

2023년 뿌리기업 별도쿼터 300명 2월 20일부터 24일까지 신청 가능

‘300 separate quotas for root companies in 2023’ can apply from February 20th to 24th

산업통상자원부는 오늘 13일에 2023년도 '뿌리기업 추천서'를 공고하고 2월 20일(월)부터 24일(금)까지 '국가뿌리산업진흥센터'에서 별도 쿼터로 400명 (상반기: 300명, 하반기: 10명)을 선발할 예정입니다.

The Ministry of Trade, Industry and Energy has announced the 2023 'Recommendation for Root Companies' on the 13th, and from February 20 (Mon) to 24 (Fri), 400 people as a separate quota at the 'National Root Industry Promotion Center' (first half: 300 people , second half: 10 people) will be selected.

(* 뿌리산업은 주조, 금형, 소성가공, 용접, 열처리, 표면처리 등 6개 기술력을 바탕으로 운영하고 있는 제조업을 말합니다.)

(* Root Industry refers to a manufacturing industry that operates based on six technologies, including die casting, mold, plastic working, welding, heat treatment, and surface treatment.)

상반기에 실시하게 되는 뿌리기업의 별도쿼터는 300명이며, 기본적인 절차는 아래와 같습니다.

The separate quota for root companies to be implemented in the first half is 300 people, and the basic procedure is as follows:

1. VISA.GO.KR에서 뿌리기업의 회사 아이디 신청 후 '뿌리기업 추천서'를 발급받아야 합니다.

1. After applying for the company ID of the root company at VISA.GO.KR, a 'root company recommendation' must be issued.

일반적으로 회사 아이디 신청은 7일~10일, 이후 '뿌리기업 추천서(산업통상자원부)' 발급 기간은 2주 정도 소요됩니다.

In general, it takes 7 to 10 days to apply for a company ID, and about 2 weeks to issue a 'root company recommendation letter (Ministry of Trade, Industry and Energy)'.

따라서 올 상반기 뿌리기업 특별 쿼터에 신청하려고 하는 외국인근로자(회사)는 빨리 준비를 해야 할 것 같습니다.

Therefore, foreign workers (companies) who want to apply for the special quota for root companies in the first half of this year should prepare quickly.

2. '뿌리기업 추천서' 발급 이후 관련 서류를 준비하여 '국가뿌리산업진흥센터'에 특별 쿼터 추천서를 발급하기 위해 서류를 보내야 합니다.

2. After issuing the 'Root Company Recommendation Letter', you must prepare the relevant documents and send them to the 'National Root Industry Promotion Center' to issue a special quota recommendation letter.

'뿌리기업 추천서'는 5점~10점까지 주어집니다.

만약 10점이 주어진다는 가정하에 42점 이상이면 추천서 점수 10점을 포함하여 52점 이상이 되기 때문에 신청할 수 있습니다.

중요한 점은 2020년과 2021년 소득금액증명원 상 매년 2,600만 원 이상의 소득이 증명되어야 합니다.

만약 2020년 또는 2021년 소득금액증명원이 2,600만 원이 넘지 않으면 추천서 점수를 포함하여 72점이 넘어야 합니다.

'Root Company Recommendation' is given from 5 to 10 points.

Assuming that 10 points are given, if it is 42 points or more, you can apply because it is 52 points or more including 10 points of recommendation.

The important point is that the income of more than 2,600 million won per year in 2020 and 2021 must be proven.

If the income amount certificate in 2020 or 2021 does not exceed 26 million won, it must exceed 72 points including the recommendation score.

3. '국가뿌리산업진흥센터'에서 최종 선발된 300명 회사에는 '고용추천서 별도쿼터 결과'가 발급되며, 해당 추천서와 모든 서류를 준비하여 관할 출입국외국인사무소에 E-7-4 비자를 신청하면 됩니다.

3. The 300 companies finally selected by the 'National Root Industry Promotion Center' will be issued with 'separate quota results for employment recommendation letters' and then you shall prepare the letter of recommendation and all documents and apply for an E-7-4 visa at the local immigration office.

'뿌리기업 특별쿼터'로 신청하는 경우, 출입국외국인사무소에 예약없이 신청이 가능합니다.

If you apply for the 'root company special quota', you can apply without a reservation at the Immigration Office.

*다시한번 말씀드리지만 VISA.GO.KR의 추천서와 '고용추천서 별도쿼터 결과'는 다릅니다.

*Once again, VISA.GO.KR's recommendation letter and 'Employment recommendation letter separate quota result' are different.

VISA.GO.KR의 추천서는 정기접수때 사용할 수 있지만 특별 쿼터에는 사용할 수 없으며, 관할 출입국외국인사무소마다 정기접수때 점수를 인정하지 않는 곳도 있습니다.

Recommendation letters from VISA.GO.KR can be used for regular applications, but not for special quotas, and some immigration offices do not recognize scores for regular applications.

'고용추천서 별도 쿼터 결과'는 '한국생산기술연구원(KITECH)'에서 발행되며, 그 결과를 관할 출입국외국인관서와 공유하고 있기에 별도쿼터에 신청한 경우라면 '고용추천서+별도 쿼터 결과' 2가지를 제출해야 합니다.

'Employment recommendation letter separate quota result' is issued by 'Korea Institute of Industrial Technology (KITECH)' and the result is shared with the competent immigration office, so if you apply for a separate quota, you will receive two types of 'employment recommendation letter + separate quota result' must be submitted.

Fast Track of Permanent residency and naturalization for Outstanding Scientific and Technological Talents

1. F-2-7S Visa (Potential Excellent Talent Residence Visa):

Those who have obtained or plan to obtain a master's or doctorate degree from specialized universities and research institutes in Korea can receive a residence visa if they receive a recommendation letter from the president of the university even if their employment is not confirmed.

The resident visa is F-2-7S, and the maximum duration is 5 years.

(*Please refer to the attachment for specialized universities and research institutes in science and engineering)

The recommendation letter from the president of a university specialized in science and engineering in Korea is only for those who are scheduled to graduate or within one year from graduation.

The F-2-7S visa is granted a two-year stay for the first time and is extended to a maximum of five years even if you do not get a job thereafter.

(*After 5 years, you must meet the requirements for F-2-7 visa and extension of stay)

Spouse of F-2-7S can obtain an F-2-71S visa and can engage in employment activities in Korea without restrictions on employment activities.

2. F-5-16S (score-based permanent residence):

You can obtain an F-5-16S visa if you score more than 90 points in the scoring system after 3 years with F-2-7S.

3. Special Naturalization of Outstanding Talent (maintaining multiple nationalities):

Those with outstanding research results can be specially naturalized after deliberation by the Nationality Deliberation Committee.

* * After 3 years on the F-2-7S visa, you can choose to apply for the F-5-16S visa or special naturalization.

과학 기술 우수인재에 대한 영주자격과 귀화 패스트트랙

1. F-2-7S 비자 (잠재적 우수인재 거주비자):

국내 이공계 특성화 대학 및 연구기관의 석사 또는 박사 학위를 취득하였거나 취득할 예정인 사람은 취업이 확정되지 않아도 해당 대학 총장의 추천서를 받으면 거주비자를 받을 수 있습니다.

해당 거주비자는 F-2-7S이며, 최대 기간은 5년 입니다.

(*이공계 특성화 대학 및 연구기관은 첨부 파일을 참조하세요)

국내 이공계 특성화 대학 및 연구기관 대학 총장의 추천서는 졸업 예정자나 졸업 후 1년 이내인 자에게만 해당됩니다.

F-2-7S 비자는 처음 체류기간 2년을 부여하고 그 이후 취업을 하지 않더라도 최대 5년까지 연장됩니다.

(*5년이 경과한 이후에는 F-2-7 비자의 점수제 요건과 체류기간 연장 요건을 충족해야 합니다)

F-2-7S의 배우자는 F-2-71S비자를 취득할 수 있으며, 국내에서 취업활동에 제약없이 취업활동을 할 수 있습니다.

2. F-5-16S (점수제 영주자격):

F-2-7S로 3년이 지나고 점수제 요건 중 90점 이상을 취득하면 F-5-16S 비자를 취득할 수 있습니다.

3. 우수인제 특별귀화(복수국적 유지):

연구실적 우수자는 국적심의위원회의 심의를 거쳐 특별 귀화를 할 수 있습니다.

Change Workplace while Working with E-7 visa E-7 비자로 근무하는 동안 사업장 변경을 하는 경우

요즘 E-7 비자로 근무하고 있는 회사에서 다른 회사로 근무처를 변경하는 것과 관련된 문의가 많이 있습니다.

(These days, there are many inquiries related to changing the place of work from the company where you are working on an E-7 visa to another company.)

저도 전화 주시는 외국인들의 상황에 맞게 설명을 해드리고 있는데, 매번 이 부분을 반복해서 설명해 드리기가 쉽지가 않아서 기본적인 정보를 제공해 드립니다. 필요하신 분들은 참고바랍니다.

(I am also explaining according to the situation of foreigners who call me, but it is not easy to explain this part repeatedly every time, so I will provide basic information. Please refer to those who need it.)

'근무처 변경'이란 취업비자(E-1~E-7)를 취득하고 현재 회사에서 일하다가 중도에 또는 계약기간이 만료된 후 새로운 회사로 근무처를 변경하는 것을 말합니다.

('Change of place of work' refers to changing the place of work to another company midway through or after the contract period expires after obtaining a work visa (E-1~E-7) and working for the ㅜnew company.)

참고로 '통합신청서'에는 '근무처 변경 또는 추가 신고'라고 되어 있습니다. '신고'라고 되어 있지만 실제적으로는 '허가'의 개념으로 이해하셨으면 좋겠습니다.

(For reference, the 'Application Form No. 34' says 'Report for change or additional workplace'. It says 'Report', but I hope you understand it as the concept of 'Permission' in practice.).

근무처를 변경한다는 것은 지금 일하고 있는 회사를 퇴직하고 다른 회사에서 일한다는 것과 같습니다.

(Changing your place of work is like leaving the company you are currently working for and working for another company.)

원칙은 근무처를 변경하는 경우에도 처음에 특정활동비자(E-7)를 신청하고 허가받은 후에 일을 해야 하지만 이미 처음 E-7 비자를 받을 때 기본 요건은 충족한 상태였기 때문에 완화된 정책이라고 보면 될 것 같습니다.

(As a rule, even if you change your place of work, you must first apply for a specific activity visa (E-7) and work after receiving permission. However, since the basic requirements were already met when you first received the E-7 visa, it seems to be a relaxed policy in the aspect of applicants point of view.)

현재 회사에서 E-7 비자를 받고 다른 회사로 근무처를 변경하려고 하는 경우, 생각해봐야 할 것이 몇 가지 있습니다.

(If you are getting an E-7 visa from your current company and are considering changing your place of employment to another company, there are a few things to think about in advance.)

1. 근로계약 기간이 남아 있는 경우, 중도 퇴사 하는 경우(중도퇴사):

If the employment contract period remains, in case of leaving the company midway (leaving the company midway):

1) 전문인력 (E-7-1) 비자 소지자 (Professional Worker (E-7-1) visa holders):

- (절차) 방문예약 후 변경할 회사 서류를 준비해서 출입국에 신청하게 됩니다. 

((Process) After making a visit reservation, prepare the company documents to be changed and apply to the Immigration Office.)

다만, 이전 회사의 '이적동의서'가 반드시 필요합니다. 

(However, 'Release Letter(=transfer agreement)' from the previous company is required.)

변경할 회사에 입사하여 취업활동을 하면서 15일 이내에 출입국에 E-7-1 비자 변경에 필요한 서류에 준하여 서류를 준비해서 신청하게 됩니다. 

(While working for the new company and doing employment activities, you shall prepare documents and apply E-7-1 visa in accordance with the documents required for changing the E-7-1 visa to the Immigration Office within 15 days.)

중요한 부분은 이전 회사의 '이적동의서'입니다. 그리고 근무처 변경하기 전에 이미 일할 회사를 정해야 합니다. 

(The important part is the 'Release Letter(=transfer agreement)' from the previous company. And before you change your workplace, you should already decide which company you will work for.)

그렇지 않으면 E-7-1 비자로 근무처 변경이 아닌 구직비자(D-10-1)로 변경해야 합니다.

(Otherwise, you must change to a job seeker visa (D-10-1), not a change of workplace at a new company with an E-7-1 visa.)

- (중요한 포인트) 이전 회사의 '이적동의서' 필수적으로 받기.

((Important point) Obtaining the ''Release Letter(=transfer agreement)' from the previous company is mandatory.)

2) 근무처 변경 또는 추가시 '허가'를 미리 받아야 하는 E-7 비자*(E-7-1, E-7-2, E-7-3, E-7-4 비자가 포함됨)(E-7 visa* (including E-7-1, E-7-2, E-7-3, and E-7-4 visas) that requires 'Permission' in advance when changing or adding a workplace):

- (절차) 방문예약 후 변경할 회사 서류를 준비해서 출입국에 신청하게 됩니다. 

((Process) After making a visit reservation, prepare the company documents to be changed and apply to the Immigration Office.)

다만, 이전 회사의 '이적동의서'가 반드시 필요합니다. 

('Release Letter(=transfer agreement)' from the previous company is required.)

전문인력 (E-7-1) 비자와 달리 변경할 회사에 입사하여 취업활동을 바로 할 수 없고, 퇴직일 다음날로부터 15일 이내에 '근무처 변경' 신청을 하고, 출입국의 '비자 허가'를 기다려야 합니다. 

(Unlike the professional worker (E-7-1) visa, you cannot join the company you want to change and work immediately, apply for "Change of Work place" within 15 days from the day after retirement, and wait for "Visa Permission" for Immigration Office.)

출입국의 비자허가 전에는 새로운 근무처에서 일을 하면 안됩니다. 

(You must not work in a new place of work until the visa is approved(=permitted) by the Immigration Office.)

중요한 부분은 이전 회사의 '이적동의서'입니다. 그리고 근무처 변경하기 전에 이미 일할 회사를 정해야 합니다. 그렇지 않으면 E-7-1 비자로 근무처 변경이 아닌 구직비자(D-10-1)로 변경해야 합니다.

(The important part is the 'Release Letter(=transfer agreement)' from the previous company. And before you change your workplace, you should already decide which company you will work for. Otherwise, you must change to a job seeker visa (D-10-1), not a change of workplace with an E-7-1 visa.)

- (중요한 포인트) 이전 회사의 '이적동의서' 필수적으로 받기, 출입국의 비자 허가 전까지 새로운 회사(근무처)에서 일하면 안됨.

((Important point) You must obtain the 'Release Letter(=transfer agreement)' from the previous company, and you must not work at the new company (place of work) until the visa is approved(=permitted) by the Immigration Office.)

2. 근로계약이 끝난 후 근무처를 변경하는 경우:

In case of changing the place of work after the employment contract ends:

1) 전문인력 (E-7-1) 비자 소지자(Professional Worker (E-7-1) visa holders):

- (절차) 방문예약 후 변경할 회사 서류를 준비해서 출입국에 신청하게 됩니다. 다만, 이전 회사의 '이적동의서'는 필요하지 않습니다. 

((Process) After making a visit reservation, prepare the company documents to be changed and apply to the Immigration Office. However, a 'Release Letter(=transfer agreement)' from the previous company is NOT required.)

변경할 회사에 입사하여 취업활동을 하면서 15일 이내에 출입국에 E-7-1 비자 변경에 필요한 서류에 준하여 서류를 준비해서 신청하게 됩니다. 

(While working for the new company and doing employment activities, you should prepare documents and apply for an E-7-1 visa in accordance with the documents required for changing the E-7-1 visa to the Immigration Office within 15 days.)

'사후 신고'이기 때문에 근로계약서에 나온 근로 기간에 맞추어 일을 먼저 시작해도 됩니다.

(Because it is a 'Post-Report(Follow up-Report)', you can start work first according to the working period specified in the employment contract.)

2) 근무처 변경 또는 추가시 허가를 미리 받아야 하는 E-7 비자*(E-7-1, E-7-2, E-7-3, E-7-4 비자가 포함됨)((E-7 visa* (including E-7-1, E-7-2, E-7-3, and E-7-4 visas) that requires 'Permission' in advance when changing or adding a workplace):

- (절차) 방문예약 후 변경할 회사 서류를 준비해서 출입국에 신청하게 됩니다. 다만, 이전 회사의 '이적동의서'는 필요가 없습니다. 

((Process) After making a visit reservation, prepare the company documents to be changed and apply to the Immigration Office. However, you do NOT need a 'Release Letter(=transfer agreement)' from your previous company.)

전문인력 (E-7-1) 비자와 달리 변경할 회사에 입사하여 취업활동을 바로 할 수 없고, 퇴직일 다음날로부터 15일 이내에 '근무처 변경' 신청을 하고, 출입국의 '비자 허가'를 기다려야 합니다. 

(Unlike the professional worker (E-7-1) visa, you CANNOT start employment activities right away by joining the company you want to change. You must apply for 'Change of Place of Work' within 15 days from the day after your retirement date and wait for 'Visa Approval(Permission)' from the Immigration Office.)

출입국의 비자허가 전에는 새로운 근무처에서 일을 하면 안됩니다. 

(You must NOT work in a new place of work until the visa is approved(=permitted) by the Immigration Office.

3) 현행 제도의 개선점(Improvements of the current system-my opinion):

특히 전문인력(E-7-1)은 큰 해당 사항이 없겠지만 점수제 숙련인력(E-7-4) 비자인 경우에는 근로계약 만료일이 외국인등록증 만료일로 되어 있는 경우가 간혹 있습니다. 

(In particular, professional workers (E-7-1) may not be applicable, but in the case of a point-based skilled workers (E-7-4) visa, the expiration date of the employment contract is sometimes set as the expiration date of the Alien Registration Card(ARC).)

이 경우, 이전 회사의 '이적동의서'가 반드시 필요할 수 있으니 이 부분 미리 준비하시기 바랍니다.

(In this case, you may need the 'Release Letter(=transfer agreement)' from the previous company, so please prepare this part in advance.)

그래서 근로자의 고용보호와 이직의 자유를 위해 모든 E-7 비자의 외국인등록증 상 체류기간을 고용계약서 만료일보다 좀 더 길게 주는 정책이 반영되었으면 좋겠습니다.

(Therefore, it is hoped that the policy of granting the period of stay on the Alien Registration Card(ARC) for all E-7 visas a little longer than the expiration date of the employment contract for the protection of employment and the freedom of employment of workers will be reflected.)

* 근무처 변경 또는 허가시 반드시 허가를 미리 받고 허가 후에 취업활동을 할 수 있는 직업군(Occupational groups in which you must obtain permission in advance when changing your place of work from Immigration Office, and then engage in employment activities after permission):
